Notes: Birchett was the first son and second child of James and Milly McHan. He preferred to be called, Birch, and was named in honor of T.F. Birchett who was an well known citizen and county clerk of Rutherford Co, NC. He lived there with his parents until his mother died in 1828 or 1829. He was living at Macon Co in 1840 census. James named him, a minor son of 17, in an 1840 power of attorney to act on behalf of his siblings. He married Sally Sarah Jane Truitt when he was 10 and she was 2. He was appointed Chairman of Commissioners at the formation of Swain County at Cold Springs Meeting House on 19 Jun 1871. John DeHart, uncle of Birch’s wife was also on the Board. His name is still on several of the small bridges in Swain Co.
Military: In 1864, he enlisted in Co. “A”, 69thReg. N.C. State Troops. His duties were “To haul provisions for the different Posts”.
Land: He received two land grants from state of NC in 1866. One for 138 acres and the other 50 acquired by treat from the Cherokee (“taken” from the Tsalagi point of view!)

Notes: (1)Sallie was “rearing” some of her grandchildren when she died according to Walter McHan whose father attended her funeral.
(2) She filed an application for a military widows pension on 11 Jun1912.

Notes: All of his children were school teachers. He owned a large tract of land at Ela.
He was known for the quality and taste of his apple brandy. He kept excellent records of his purchases and sales and had a disagreement with the feds over the increased tax and was fined for refusing to pay the increase. I have his whiskey tasting cup and his ledger notes for his brandy making enterprise.

Jobs: Was a schoolteacher. A list of Swain Co teachers 1921 notes that he was head of the Mingus schoolhouse and paid $60/month) . There is a “tribute” to N. R. from a former student in the N.R. McHan file.
Will: “In the Name of God: I, Robert McHan of the County of Swain and State of North Carolina being of sound and disposing mind memory and understanding, but considering the uncertainty of my earthly existence do make, publish and declare this my Last Will and Testament: (1) I direct that my Executrix, hereinafter named shall give my body a decent burial after m death and pay all of my funeral expenses
and all of my just debts out of my estate: (11) All my property of whatever kindm and wheresoever situate, land and personal property I devise and bequeath to my faithful and beloved wife, Eva McHan, to be hers absolutely to do with as she pleases. There is excepted from the above Real estate, the following: One half acre (1/2 acre) of land in Cemetery also a Right of Way for a Road 14 foot wide leading up the branch through Section six to the Cemetary. (111) I hereby nominate, constitute and appoint my said wife, Eva McHan, the Executrix of this my Last will and Testament and direct that she be allowed to quality and serve without any bond being required of her. witness m hand and seal, this 13thDay of July 1932.

illnesses: High BP, hysterectomy after the last child, died of a stroke
m. (1) 4 Aug 1907 to Noah Robert “Bob” McHan at the Methodist Church (He was Presbyterian and she was Baptist and this was the solution. She returned to the Galbrieth Creek Baptist Church after he died.
